Debt is exhausting. The calls, the letters and the fear of a knock on the door wear people down. Yet millions of Americans have used the law to reset their finances and start again.
Our bankruptcy and debt relief services in the USA help you understand your options, stop collection action and prepare your case correctly. Every service has a fixed price.
Importantly, filing for bankruptcy triggers the "automatic stay". That court order generally stops most collection activity β lawsuits, garnishments and many foreclosures β as soon as the case is filed. Consequently, bankruptcy can bring immediate relief.
Chapter 7 or Chapter 13?
Chapter 7 is often called "liquidation". In practice, many filers keep all or most of their property thanks to exemptions. Most unsecured debts, such as credit cards and medical bills, can be discharged in a few months.
However, you must pass the means test. It compares your income to your state's median and looks at your expenses. Our Bankruptcy Means Test Calculation and Chapter 7 eligibility review tell you whether you qualify.
Chapter 13 is a repayment plan lasting three to five years. It suits people with regular income who want to keep a home or car and catch up on missed payments. A Chapter 13 eligibility review compares the options. Therefore, you choose the chapter that protects the most.
Preparing your petition correctly
A bankruptcy petition requires full disclosure of income, assets, debts and recent transactions. Mistakes can lead to dismissal. Worse, hiding assets can cost you your discharge.
Our Chapter 7 Bankruptcy Petition Preparation and Chapter 13 Bankruptcy Petition Preparation services prepare the petition, schedules and statement of financial affairs. Additionally, a Bankruptcy Creditor Matrix makes sure every creditor is notified.
Already prepared your paperwork? A bankruptcy document review checks it before you file. Moreover, remember that you must complete credit counseling from an approved provider before filing, and a debtor education course before discharge.
Stopping garnishment, repossession and foreclosure
If a creditor has a judgment, it may garnish your wages or levy your bank account. Federal law caps most wage garnishment, and some states protect more. A wage-garnishment consultation explains how to reduce or stop it.
If your car is at risk, a repossession consultation covers reinstatement, redemption and bankruptcy options. Similarly, if you are behind on your mortgage, a foreclosure consultation explains loan modification, forbearance and Chapter 13.
Timing matters in each case. For example, filing before a foreclosure sale can stop it, while filing afterwards usually cannot undo it. Therefore, get advice as soon as the first notice arrives.
Debt collectors and lawsuits
Debt collectors must follow the federal Fair Debt Collection Practices Act. They cannot harass you, lie or threaten action they cannot take. A creditor harassment consultation explains how to stop abusive contact.
If you have been sued, respond before the deadline. A debt-collection lawsuit review checks whether the collector can prove the debt and whether it is time-barred. Then, an Answer to a Lawsuit puts your defenses on record.
Not ready for bankruptcy? A debt-relief consultation compares settlement, consolidation and bankruptcy honestly. As a result, you choose the route that fits your situation.
For creditors
Bankruptcy affects creditors too. If a customer or borrower files, you may need to submit a claim to share in any distribution. Our Proof of Claim (for Creditors) prepares it with supporting documents.
Additionally, a bankruptcy case strategy consultation helps both debtors and creditors with complex cases β for instance, where businesses, multiple properties or disputed debts are involved.

Frequently asked questions
Will I lose my house if I file for bankruptcy?
Not necessarily. Homestead exemptions protect some or all home equity in many states, and Chapter 13 lets you catch up on missed mortgage payments over time.
What debts cannot be discharged in bankruptcy?
Common examples include most student loans, recent tax debts, child support, alimony and debts from fraud. Some can be discharged only in limited circumstances.
Does bankruptcy stop wage garnishment?
Yes. The automatic stay generally stops most garnishments as soon as the case is filed, with some exceptions such as domestic support obligations.
How long does bankruptcy stay on my credit report?
Chapter 7 can remain for up to ten years and Chapter 13 for up to seven. Many people nonetheless begin rebuilding credit soon after discharge.
Do I have to take a course before filing?
Yes. You must complete credit counseling from an approved agency within 180 days before filing, and a debtor education course before receiving your discharge.
