Landlord, Tenant & Eviction Legal Services in the USA — Leases, Notices & Defense in All 50 States

By the LegalCounsel legal team · Updated September 2026

Housing problems are urgent. A tenant stops paying rent. A landlord refuses to return a deposit. An eviction notice appears on the door with a date that feels impossibly close. In each case, what you do in the next few days matters.

Our landlord, tenant and eviction legal services in the USA give both landlords and tenants attorney-prepared documents for their state — at a fixed price and delivered online. Notably, landlord-tenant law is intensely local. For example, notice periods, deposit deadlines and eviction steps differ between Florida, New York and California. Therefore, every document is prepared for the property's location.

Whether you need a watertight lease, a valid notice or a defense to an eviction, a licensed attorney prepares it for you.

For landlords: start with the right lease

Most landlord problems begin with a weak lease. A generic template may miss your state's required disclosures. Similarly, it may include clauses a court will refuse to enforce. As a result, you lose leverage exactly when you need it.

A properly drafted Residential Lease Agreement sets out rent, late fees, deposits, repairs, access and termination in terms your state allows. In addition, it includes disclosures such as lead-based paint notices for older homes.

If you let several units, the Landlord Legal Document Bundle packages the lease with notices and letters you will need later. Meanwhile, commercial landlords can order a Commercial Lease Agreement that addresses CAM charges, build-outs and personal guarantees.

Screening and guarantors

A Lease Guaranty Agreement makes a parent or co-signer responsible if the tenant falls behind. Consequently, you have a second route to recover unpaid rent.

Evictions: notices must be exactly right

An eviction usually starts with a notice. For unpaid rent, this is often a Notice to Pay Rent or Quit. For other breaches, it may be a Lease Violation Notice or a notice to vacate.

Here is the problem. If the notice period is wrong, or the notice is served incorrectly, the court can dismiss the case. Then you must start again — while the rent keeps going unpaid. For instance, some states require three days' notice for non-payment, while others require more, and some exclude weekends and holidays.

Our Eviction Case Preparation service goes further. It covers the complaint, the evidence and the hearing. Moreover, it flags local protections, such as just-cause rules in parts of California, New Jersey and New York City.

Importantly, landlords must never use "self-help" eviction — changing locks or removing belongings without a court order. It is illegal in most states and can lead to damages. Instead, follow the court process and get it right the first time.

For tenants: know your rights and use them

Tenants have more protection than many realise. However, those protections only help if you use them in time.

If your landlord kept your deposit, a Security Deposit Demand Letter cites your state's return deadline. Many states require the landlord to return the deposit, or an itemised list of deductions, within a set number of days. In fact, several states allow tenants to recover double or triple the deposit when a landlord acts in bad faith.

If repairs are ignored, a Tenant Repair Demand Letter puts the landlord on formal notice. That notice often matters later — for example, before you can withhold rent or repair and deduct where your state allows it.

If you have received an eviction notice, act immediately. An eviction-notice review tells you whether it is valid. Similarly, a tenant-defense consultation helps you prepare for court. Often, defects in the notice or the landlord's own breaches give you a strong defense.

Buying, selling and transferring property

Real estate is usually a family's biggest asset. Consequently, the documents behind it deserve care.

A Real Estate Purchase Agreement sets out price, contingencies, inspections and closing. Before you sign one drafted by the other side, a home purchase agreement review tells you what each clause means for you.

To move property between family members, a Quitclaim Deed is often the simplest tool. Alternatively, a Warranty Deed gives the buyer full title protection. Meanwhile, a Transfer-on-Death Deed can pass a home to your heirs without probate in many states.

Finally, neighbor disputes can escalate quickly. A Neighbor Dispute Letter raises boundary, fence, tree or noise issues calmly and formally — often settling them before anyone goes to court.

Frequently asked questions

How much notice does a landlord have to give before eviction?

It depends on your state and the reason. Non-payment notices are often three to fourteen days, while notices to end a month-to-month tenancy are often thirty days or more. Local rules can add requirements, so the notice must be prepared for your property's location.

How long does a landlord have to return a security deposit?

Most states set a deadline between 14 and 45 days after the tenancy ends. The landlord must either return the deposit or send an itemised list of deductions. Missing the deadline can entitle the tenant to extra damages in many states.

Can a landlord change the locks to evict a tenant?

In most states, no. So-called self-help evictions are illegal. The landlord must obtain a court order, and only a law enforcement officer can carry out the removal.

Do you help tenants as well as landlords?

Yes. We prepare documents for both sides — leases, notices and eviction paperwork for landlords, and deposit demands, repair demands and eviction defenses for tenants.

Can you prepare a lease for my state?

Yes. Every lease is prepared for the state where the property is located, including required disclosures and clauses your state permits.
